Activity Waiver and Release of Liability

Provider: Youssef Razzouk's Aquatic Leadership Training (“YRALT”)

Activity: Private swim lessons - LSS courses - First Aid & CPR courses - Home Alone and Babysitting courses - Aquatic Safety Inspections (“Activity”).

1) General Authorization

By accepting this waiver, I confirm I am at least 18 years of age and I am one of the following:

The sole participant in the Activity and I agree to the terms in this waiver.
A participant and the parent/legal guardian of other participant(s), and I have authority to register them and bind them and myself.
Not a participant, but the parent/legal guardian of the participant(s), and I have authority to register them and bind them and myself.

2) Medical Authorization (Emergency)

In an emergency, I authorize YRALT and its staff to take reasonable steps to obtain medical treatment for any participant, including arranging transportation and emergency care if required. Each participant is responsible for their own medical coverage and related costs.

3) Assumption of Risk

I understand aquatic activities involve inherent risks, including slips and falls, collisions, water-related injury, medical events, and equipment-related incidents. I voluntarily participate (and/or allow the participant(s) to participate) and fully assume all risks, including the possibility of personal injury, death, property damage, expense, and related loss.

4) Release and Waiver

To the fullest extent permitted by law, I waive and forever release YRALT, its owners, directors, officers, employees, instructors, contractors, agents, and volunteers (the “Released Parties”) from any and all claims, demands, actions, damages (direct, indirect, special, and/or consequential), losses, judgments, and costs (including legal fees) arising out of or connected with:

the Activity; and/or
my and/or any participant’s participation in the Activity; and/or
attendance at the facility where the Activity is provided.

5) Indemnity

I agree to indemnify, defend, and hold harmless the Released Parties from and against claims, liabilities, damages, and expenses (including legal fees) arising out of or related to:

any act or omission by me and/or any participant, or anyone for whom I/they are responsible; and/or
my and/or any participant’s participation in the Activity and/or attendance at the facility.

6) Facility Rules and Third Parties

If the Activity is provided at a third-party facility (for example, a hotel or pool operator), I agree to follow all posted rules and staff instructions. YRALT is not responsible for the actions or omissions of third-party facility operators. Additional facility waivers or terms may apply.

7) Governing Law

This waiver is governed by the laws of Ontario and the laws of Canada applicable in Ontario.

8) Electronic Acceptance

Checking the acceptance box and submitting the registration form constitutes my electronic signature and acceptance of this waiver. YRALT may store the acceptance date/time, waiver version, and participant details as proof of acceptance.
